<br><div class="gmail_quote">On Thu, Jun 1, 2017 at 11:52 AM, Darrell Fevergeon <span dir="ltr"><<a href="mailto:darrell@bendbroadband.com" target="_blank">darrell@bendbroadband.com</a>></span> wrote:<br><blockquote class="gmail_quote" style="margin:0 0 0 .8ex;border-left:1px #ccc solid;padding-left:1ex"><div lang="EN-US" link="blue" vlink="purple"><div class="m_1364015056805342921WordSection1"><p class="MsoNormal"><span style="font-size:13.0pt">Greetings,<u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">This is a brief update and summary for our membership:<u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">Way back in 2011 and into 2012, our treasurer, Tim Bass, stole over $4000.00 of HIDARG funds for personal use.  After much discussion, and based on Tim’s lack of expression of remorse or desire to repay us, our board decided that we needed to turn it over to the Bend Police Department.  <u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">We attended the numerous court hearings.  A bench warrant was filed when Tim did not show up in court.  Subsequently, he was charged and found guilty of both felony and misdemeanor charges and ordered to make restitution to HIDARG.  His testimony was he could pay $150.00 per month.  The court ordered that one of his ham radios would be turned over to HIDARG as partial restitution (around $1100).  <u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">Finally, we felt we would be able to sit back and receive regular payments.  <b>Wrong!</b><u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">After some time, no money had been received by HIDARG.  I learned the court/DA had not filed the needed forms properly.  After many contacts, that got fixed.  <u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">Then, after no restitution was received, I learned his Probation Officer was the one to ensure payments.  Money barely trickled in after numerous contacts and pleas with his PO.  Then in early Fall of 2016, after not receiving email responses, I learned his  P.O. had retired and it took some time for a replacement to be set.     Finally, I had a contact with his new P.O.  Since Tim’s probation time was to end soon, I asked Tim NOT be released from probation until the restitution had been completed.  He told me he would.  <u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">After no more money was received, I contacted Tim’s new PO who THEN told me Tim Bass had been released from probation and there was nothing further that could be done regarding restitution owed ($2042.94). He told me the State would (as for 2015) seize Tim’s tax refund for us. <u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"> At this point, Katrina Knapp assisted with suggestions her contacts in the legal field had.  My 2^nd letter to Judge Adler resulted in a referral to the DA’s office.  Additionally, my letter - personally delivered to the DA’s clerk who told me she would put it on his desk “right away” - resulted in no response.  <u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">At this point, our Board decided it would be best not to turn “political” with our plea for justice as some members suggested out of frustration.  Instead, it was decided to contact one or more County Commissioners requesting they might get some movement with the DA.  Ray Spreier contacted Tony and Tammy for us.  Finally, a DA’s response: mostly explaining he had not receive our request and informing there is nothing he could do now.  He did, however, just receive information the State had seized Tim’s 2016 tax refund of $992.<u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">Tim now owes us $1050.92.  If his State tax refund continues, we should be fully reimbursed by this time in 2019.<u></u><u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt"><u></u> <u></u></span></p><p class="MsoNormal"><span style="font-size:13.0pt">It has been a long frustrating expenditure of time and effort through these 5 y
